1. Acceptance of Terms

By downloading, installing, or using The Critiqueur ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the application.

2. Eligibility

You must be at least 14 years old to use The Critiqueur. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Use of the App

The Critiqueur provides AI-generated critiques of photos you submit. You are responsible for any content (photos) you submit through the App. You agree not to use the App to:

• Submit illegal, offensive, or infringing content
• Submit photos of other people without their consent where consent is required
• Attempt to circumvent quota, attestation, or purchase verification mechanisms
• Violate any applicable laws or regulations
• Infringe on the rights of others

4. AI-Generated Content

Critiques, verdicts, scores, and badges are generated by artificial intelligence in a deliberately theatrical, exaggerated critic persona. They are provided for entertainment and general guidance only:

• Critiques may be inaccurate, inconsistent, or subjective, and do not represent professional artistic, educational, or commercial advice.
• Scores and badges have no monetary value and may vary between similar photos.
• The critic's tone is intentionally dramatic and snobbish; it is part of the product's character and is not directed at you personally.

5. Tokens, Subscriptions, and Purchases

• Tokens: Each critique consumes one token. Tokens are a prepaid usage allowance, not currency; they have no cash value, are non-transferable, and cannot be redeemed or exchanged.
• Free trial: A limited number of free critiques may be granted per device or user. We may use platform attestation to prevent trial abuse and may refuse grants to devices that fail verification.
• Subscriptions: Monthly plans provide a critique quota that resets on renewal. Unused subscription quota does not carry over. Subscriptions renew automatically until cancelled through your App Store or Google Play account settings.
• Token packs: Consumable packs do not expire and are linked to the device that purchased them.
• Payments: Payments are processed through the Apple App Store or Google Play Store. All sales are subject to the refund policies of the respective platform; we cannot issue refunds directly.
• Changes: We may change plan sizes, pack sizes, and prices for future purchases. Changes do not affect tokens you have already been credited.

6. Service Availability

Critique generation requires an internet connection and depends on our servers and third-party AI providers. We strive for high availability but do not guarantee uninterrupted service. Tokens are not consumed for critiques that fail to generate. We reserve the right to modify, suspend, or discontinue the service; if the service is permanently discontinued, we have no obligation to compensate for unused tokens beyond what applicable law requires.

7. Your Content

You retain all rights to the photos you submit. By submitting a photo you grant us a limited license to transmit and process it (including via third-party AI providers acting on our behalf) solely to generate your critique and operate the service. Because sessions and photos are stored locally on your device, we are not responsible for any loss of data resulting from device failure, app uninstallation, or accidental deletion.

8. Intellectual Property

The App, including its design, graphics, code, critic persona, and content (excluding your photos), is owned by the developer and is protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the App.

9. Limitation of Liability

The Critiqueur is provided "as is" without any warranties, express or implied. To the fullest extent permitted by law, the developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of the use or inability to use the App, including but not limited to lost photos, data, or profits, or any decisions made in reliance on AI-generated critiques.

10. Termination

We reserve the right to terminate or suspend your access to the App or its online services at any time, without notice, for conduct that we believe violates these Terms, abuses the quota or trial system, or is harmful to other users or the App.

11. Changes to These Terms

We may update these Terms of Use from time to time. We will notify you of any material changes by updating the "Last Updated" date at the top of this page. Your continued use of the App after such changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Cyprus, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Cyprus.
